JUUL Labs and Altria appeal B.C. class action certification

JUUL Labs and Altria Group are appealing a British Columbia Supreme Court decision that certified a class action lawsuit against them. The lawsuit, initiated in 2019 by Owen Mann-Campbell and Robert Osborn, alleges the companies engaged in deceptive marketing by presenting e-cigarettes as a safe alternative to smoking.

Plaintiffs claim the companies are liable for negligence, breach of consumer protection laws, and unjust enrichment. While the certification allows the case to proceed as a class action, it is not a formal finding of fault. This marks the second attempt by the companies to appeal the certification in the B.C. Court of Appeal.

In a separate matter, the B.C. government has filed a suit to recover healthcare costs associated with vaping, though that case is in its early stages. Rob Cunningham of the Canadian Cancer Society characterized the appeal as part of a tobacco industry strategy to delay legal proceedings and damage payments.
