Kalshi faces regulatory fragmentation amid conflicting federal court rulings
Conflicting federal appellate rulings regarding Kalshi, a CFTC-regulated prediction market, are creating a fragmented regulatory landscape for event contracts in the United States. While the Third Circuit previously issued a decision favoring Kalshi in a case involving New Jersey, the Tenth Circuit has since ruled in favor of Utah, affirming the state's authority to enforce its gambling laws against Kalshi’s sports-event contracts.
Kalshi argues that its contracts fall under the exclusive federal framework of the Commodity Exchange Act, which would prevent states from classifying them as illegal sports betting. However, the Tenth Circuit's decision marks the second federal appeals court to reject this federal preemption argument.
In response to these diverging legal interpretations, New Jersey has filed a petition for a writ of certiorari with the U.S. Supreme Court, seeking a definitive ruling on whether state sports-gambling laws can be applied to contracts traded on a federally registered market.
