Kansas judge restores transgender driver's license

A Douglas County District Judge has reinstated the driving privileges of Jamie Miller, a transgender resident of Kansas, after her license was invalidated under Senate Bill 244. The law requires that gender markers on driver’s licenses align with a person’s sex assigned at birth.

Judge James McCabria ruled that the Kansas Department of Revenue likely violated Miller’s right to due process. The decision focused on the state’s procedural failures rather than the legality of the gender marker requirement itself. The judge noted that the state provided confusing and contradictory instructions regarding the invalidation of the license and the ability to appeal the decision.

Miller’s legal challenge argued that the loss of her license compromised her ability to care for her disabled adult daughter. While the ruling restores her ability to drive, it does not determine whether her license must ultimately reflect her sex assigned at birth. The broader legal standing of Senate Bill 244 remains subject to ongoing scrutiny and other pending cases.
