Kapil Sibal calls parliamentary panel's Supreme Court visit unconstitutional

Rajya Sabha MP Kapil Sibal has criticized a planned visit by the parliamentary committee examining the ‘One Nation, One Election’ bills to the Supreme Court, labeling the move ‘unconstitutional’. Sibal argued that the proposed informal discussion with judges regarding simultaneous elections violates the principle of separation of powers.

According to Sibal, the committee intended to brief judges on the merits of the legislation, which includes the Constitution (One Hundred and Twenty-Ninth Amendment) Bill, 2024, and the Union Territories Laws (Amendment) Bill, 2024. Sibal noted that such a move is unprecedented, as the judiciary is tasked with determining the constitutionality of laws that may later be challenged in court.

Reports indicate that the panel has since cancelled its scheduled visit to the Supreme Court.
