Kathy Hochul proposes closing New York's voluntary intoxication loophole
New York Governor Kathy Hochul has announced a proposal to the state legislature aimed at closing the “voluntary intoxication loophole” in sexual assault laws. The initiative follows public attention surrounding the “Cornell Seven” case, involving allegations of sexual misconduct at Cornell University.
Under current New York law, the ability to bring charges in certain cases has been impacted by the voluntary consumption of alcohol or drugs. Hochul’s proposal seeks to establish that choosing to consume alcohol does not constitute consent and should not serve as a legal defense against sexual assault charges.
