Kelowna RCMP officers sued over alleged unlawful search and seizure
Darko Kolundzic, owner of Alberta-based Impact Concrete Ltd., has filed a civil lawsuit against Kelowna RCMP officers following an alleged unlawful search and seizure on July 5, 2026. The incident occurred on Highway 97 when Kolundzic was pulled over in a 2021 Range Rover Sport owned by his company.
According to the Notice of Civil Claim, Constable Palmer and an unidentified officer searched the vehicle despite Kolundzic denying the request. The officers allegedly seized $12,770 in cash, a wallet, two phones, luggage, sunglasses, a watch, and the SUV itself. Kolundzic claims the officers had no reasonable grounds for the search and failed to inform him of his right to legal counsel or the reason for his detainment.
The lawsuit seeks the return of all seized items and damages for constitutional rights violations and the torts of conversion and detinue. Kolundzic alleges the officer was acting as an agent of the Director of Civil Forfeiture during the stop. As of the filing, no criminal charges have been laid against Kolundzic, and no civil forfeiture proceedings have been initiated. The RCMP has declined to comment on the matter as it is currently before the courts.
