Kentucky imposes new restrictions on data center development

Kentucky Governor Andy Beshear has issued an executive order to increase state oversight of data center development. The order requires developers to prove that new projects will not increase household electricity costs or damage natural resources such as wetlands, air quality, and water supplies.

Under the new mandate, applicants must submit detailed energy plans and demonstrate compliance with environmental regulations. The order also directs the Kentucky Public Service Commission to block utility rate increases linked to data center operations. While local governments maintain zoning authority, the state will now require more transparency regarding project locations, details, and job opportunities.

This regulatory shift comes amid community concerns regarding the rapid expansion of data centers driven by artificial intelligence. In Hancock County, residents expressed opposition to a project by Maryland-based developer TeraWulf, which has signed a 20-year contract with AI company Anthropic for a site in Hawesville. While the project promises millions in tax revenue and 100 jobs, local citizens voiced fears that the massive energy demands of such facilities could drive up already high electricity bills.
