Kenya courts rule on corruption and land fraud cases

The High Court has quashed corruption charges against Trans Nzoia Governor George Natembeya, awarding him KSh2.5 million in damages. Justice Bahati Mwamuye ruled that the criminal proceedings were unlawful and unconstitutional, citing procedural violations, denial of legal representation, and the use of unlawfully obtained evidence. The court prohibited further investigations or prosecution regarding the matter, which involved allegations of financial irregularities.

In a separate legal development, former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been convicted in a KSh1.35 billion land fraud case. Chief Magistrate Dolphina Alego found Chelogoi guilty on five counts related to the fraudulent registration of a 7.39-hectare parcel of land in Lower Kabete. The court determined that Chelogoi and an accomplice conspired to deprive businessmen of the property, noting that the defendant failed to provide a lawful basis for his ownership claims.
