Kenya National Assembly clarifies election livestreaming provisions
The National Assembly has dismissed claims that it passed legislation to remove the requirement for the Independent Electoral and Boundaries Commission (IEBC) to livestream election results. The controversy surrounds the Elections (Amendment) (No. 2) Bill, 2024, which is part of electoral reforms following recommendations from the National Dialogue Committee (NADCO).
National Assembly Majority Leader Kimani Ichung’wah and Cabinet Secretary Opiyo Wandayi both stated that the livestreaming provision remains intact. Officials clarified that while the Senate had initially proposed changes to Section 39 of the Elections Act via Clause 22, the National Assembly subsequently deleted that specific clause. This deletion effectively preserves the existing legal requirement under Section 39(1G) for the IEBC to establish a mechanism for livestreaming results as they are announced at polling stations.
The legislative process is ongoing, and the amended Bill is expected to return to the Senate for consideration. Beyond result transmission, the Bill includes proposed changes to voter registration, political party nominations, and procedures for recalling Members of Parliament.
