Kenya regulator orders mobile networks to bypass SMS opt-outs for emergency alerts
The Communications Authority of Kenya (CA) has directed all mobile network operators to send government-approved emergency bulk SMS messages to all active subscribers. This directive temporarily exempts emergency communications from standard opt-in and opt-out requirements, including Do-Not-Disturb (DND) settings and previous promotional message blocks.
The measure is intended to facilitate preparations for El Niño rains and a simulation exercise for the National Early Warning System (NEWS) scheduled for October 2, 2026. The CA stated that the directive is based on constitutional provisions requiring the State to publicize information affecting the nation.
Mobile operators, including Safaricom, Airtel, Telkom, and Jamii Telecommunications, must prioritize these emergency alerts and ensure prompt delivery. The exemption applies specifically to government-authorized public safety and disaster preparedness messages and is not a blanket suspension of all SMS privacy preferences.
