Kenya's ODPP establishes new division for 2027 election offences

The Office of the Director of Public Prosecutions (ODPP) has established a dedicated division to handle electoral-related offences in preparation for Kenya’s 2027 General Election. Speaking at a forum at the University of Nairobi, Director of Public Prosecutions Renson Ingonga stated that the new division will utilize specially trained prosecutors to ensure the timely and effective prosecution of crimes committed during the electoral period.

Ingonga warned that individuals engaging in violence, hate speech, intimidation, or cybercrime to disrupt the electoral process will face the full force of the law. He emphasized that prosecution decisions would be made independently and based strictly on evidence. The ODPP intends to collaborate with the National Police Service and the National Cohesion and Integration Commission to maintain a peaceful environment.

However, the DPP noted several challenges, including the difficulty of prosecuting hate speech on digital platforms when evidence is held by service providers based outside of Kenya. Additionally, delays in reporting offences and the time required for investigations can impact the prosecution process, as the ODPP typically receives cases only after investigations are completed.
