Kerala Assembly passes resolution to remove Chief Election Commissioner

The Kerala Legislative Assembly has passed a historic resolution seeking the removal of Chief Election Commissioner (CEC) Gyanesh Kumar. The motion, moved by Chief Minister V. D. Satheesan, marks the first time a state assembly in India has taken such a step against a CEC.

The resolution cites serious concerns regarding the Special Intensive Revision (SIR) of electoral rolls. It alleges that the process involved technical manipulations and irregularities that resulted in the wrongful removal of eligible voters, including minorities, migrant workers, and young voters. Specifically, the resolution claims that software used during the revision bypassed the authority of Electoral Registration Officers and that Form 6 was amended in violation of existing rules.

The assembly presented three primary demands: the immediate restoration of voting rights to those improperly excluded, the initiation of formal proceedings to remove Gyanesh Kumar due to concerns over institutional impartiality, and a reform of the selection committee for Election Commissioners. The proposed new panel would include the Prime Minister, the Leader of the Opposition in the Lok Sabha, and the Chief Justice of India.

The resolution was supported by the Left Democratic Front (LDF) but faced opposition from three BJP MLAs, who questioned its legality and argued that the matter should not be addressed while sub judice.
