Kerala High Court allows compensation talks for MSC Elsa-3 sinking
The Kerala High Court has permitted a special committee of government officers to resume negotiations with Mediterranean Shipping Company (MSC) regarding the sinking of the container ship MSC Elsa-3. The talks will address environmental damage, restoration costs, remediation, and economic losses suffered by the state and local fishing communities.
The Liberian-flagged vessel sank off the Kerala coast in May 2025, carrying cargo including calcium carbide, rubber chemicals, and plastic nurdles. This decision lifts a previous June 2025 court order that had deferred negotiations due to concerns regarding transparency and binding agreements.
While the committee may resume assessment and negotiation processes, the court stipulated that no final settlement or binding agreement can be concluded without further oversight. Additionally, stakeholders, including the Kerala State Pollution Control Board, have been given one week to provide input on the scope of a proposed multi-beam survey of the wreck.
