Pinarayi Vijayan moves Supreme Court against Kerala High Court FIR order

Former Kerala Chief Minister Pinarayi Vijayan has approached the Supreme Court to challenge a Kerala High Court order directing the registration of a First Information Report (FIR) in the CMRL-Exalogic bribery case. Vijayan, along with his daughter Veena T and son-in-law P. A. Muhammed Riyas, is seeking protection from arrest and a stay on vigilance proceedings.

The legal challenge follows a decision by a Kerala High Court division bench to dismiss their petitions for leave to appeal. The division bench upheld a single-judge order that directed the Vigilance and Anti-Corruption Bureau (VACB) to register an FIR based on information provided by the Enforcement Directorate (ED). The court noted that an accused in a corruption case has no legal right to be heard before an FIR is registered.

The case involves allegations that Cochin Minerals and Rutile Limited (CMRL) made fraudulent payments totaling Rs 2.78 crore to Exalogic Solutions, an IT firm owned by Veena T, under the guise of consultancy services. The Enforcement Directorate has summoned Vijayan for questioning regarding these transactions.

The Supreme Court, led by Chief Justice of India Surya Kant, has declined an urgent hearing but indicated the matter may be heard when the court reopens on October 26, or potentially via a vacation bench during the Dussehra break.
