Kojo Oppong Nkrumah seeks Supreme Court review of judicial vacation ruling

Kojo Oppong Nkrumah, the MP for Ofoase-Ayirebi, has filed a 175-page application with the Supreme Court seeking to overturn a ruling by Justice Gabriel Scott Pwamang. The application challenges the decision to allow selected High Court judges to conduct criminal trials during the judiciary’s legal vacation, which runs from August 1 to September 30.

Oppong Nkrumah argues that the previous ruling improperly addressed substantive constitutional questions at an interlocutory stage and questions whether the Attorney-General can represent the Chief Justice in proceedings involving the Chief Justice’s own administrative directives. He contends that the public interest requires interim relief to suspend these trials until the constitutional challenge is resolved.

In a related development, the Accra High Court dismissed an application by former Signals Bureau Director-General Kwadwo Adu Boahene to adjourn his trial. Adu Boahene, who faces 11 charges including money laundering and conspiracy, sought to pause proceedings pending the Supreme Court’s review of the legal vacation issue. However, Justice Francis Apanga Achibonga ruled that the previous Supreme Court decision remains binding until officially reversed, denying the request for an adjournment.
