Kosovo Courts and Bar Association Clash Over War Crimes Trial Delays

Two scheduled war‑crimes trial sessions in Kosovo – one concerning the Reçak massacre and another on the banning of Albanians during the last war – were postponed after several defendants and many court‑appointed lawyers failed to appear. Judges complained that the Bar Association did not communicate the identities of the assigned counsel, prompting questions from the media that went unanswered.

The Kosovo Special Prosecutor’s Office said the issues must be addressed through cooperation between the Judicial Council and the Bar Association to avoid future procedural setbacks. Representatives of the Bar Association and the Human Rights Fund called for improved coordination between the court president and the Bar Association head, noting that the new criminal procedure code requires timely defence representation. Lawyer Ardian Bajraktari emphasized that the right to defence is a fundamental guarantee throughout the trial process.
