Kosovo Sovereign Fund formation stalled by Constitutional Court

The formation of Kosovo's Sovereign Fund and the dissolution of the Kosovo Privatization Agency (AKP) remain stalled due to a pending decision from the Constitutional Court. Prime Minister Albin Kurti indicated that the lack of a final ruling has prevented the law from entering into force.

The law was challenged by the PDK and LDK political parties. Legal representative Faton Fetahu argued that 11 articles of the law conflict with at least seven articles of the Constitution, stating the challenge is necessary to protect the constitutional order and define economic rules. Fetahu also expressed concern over the nearly three-year delay in receiving a court decision.

Economists have voiced skepticism regarding the feasibility of the plan. Fidan Qerimi noted that the creation of the Fund has been a goal of the Kurti administration since its inception but argued that, in practice, it may not be realized and could potentially increase bureaucracy and complicate the management of public enterprises.
