Kosovo Supreme Court Dismisses Government Lawsuit Against Bar Association

The Supreme Court of the Republic of Kosovo, in decision P. A. no. 17/2026, dismissed as inadmissible the lawsuit filed by the Government's Ministry of Justice against the Bar Association of Kosovo. The court ruled that the subject of the suit fell outside its jurisdiction, so it did not examine the merits of the claims.

The Bar Association said it will not recognize or implement any decision, act or order issued by bodies acting beyond their legal competence, stating “Oda e Avokatëve e Kosovës nuk do të njohë dhe nuk do të zbatojë asnjë vendim, akt apo urdhër të nxjerrë nga organe që veprojnë jashtë kompetencave të tyre ligjore.” The association emphasized that its autonomy is a constitutional guarantee for the independence of lawyers and the right of citizens to a free defence. The Supreme Court’s ruling is final and not subject to appeal.
