KVKK restricts employer monitoring of corporate communications

The Personal Data Protection Authority (KVKK) has issued new regulations regarding the monitoring of employees' corporate email and other communication channels. Published in the Official Gazette, the decision clarifies the principles employers must follow when auditing communication tools provided for work purposes.

While employers own the corporate accounts, the ruling establishes that this ownership does not grant unlimited access to employees' personal data. To conduct monitoring, employers must demonstrate a legitimate purpose and ensure that the methods used are both relevant and proportionate. Accessing the actual content of communications is considered a more significant intervention than reviewing traffic logs or metadata.

Under the new rules, employers are required to provide clear and understandable prior notification to employees. This notification must specify the purpose of the audit, its legal basis, scope, method, data retention periods, and the rights of the employees. General statements such as ‘corporate emails may be monitored’ are no longer sufficient.

The scope of these regulations extends beyond email to include internal messaging applications, corporate instant messaging accounts, customer relationship management systems, and chat or recording areas within meeting platforms.
