La Rioja Superior Court rejects appeal to exclude evidence in dismissal case
The Superior Court of Justice has rejected an appeal seeking to exclude evidence from a dismissal lawsuit in La Rioja. The dispute arose when the defendant opposed the inclusion of certain reports and official documents, arguing they were added after the originally scheduled hearing date.
Judge Ariel Marcos of the 6th Labor and Conciliation Court had previously allowed the evidence, prioritizing the search for material truth and effective judicial protection. The court ruled that strict formal application of procedural rules should not prevent the inclusion of elements useful for clarifying the facts of the case. The court also noted that the documents were issued before the hearing, which had been suspended by mutual agreement for conciliation efforts. The defendant's appeal to the Superior Court was ultimately denied, confirming the original ruling and imposing legal costs on the defendant.
