Labor discrimination lawsuits filed in Mexico and Spain

Legal disputes regarding labor discrimination based on health conditions are emerging in different jurisdictions. In Mexico, a woman named Rocío is involved in a long-standing legal battle against the company ACCIONA. After being dismissed following a period of incapacity due to cancer, the Supreme Court of Justice of the Nation ruled in 2017 in favor of her reinstatement and compensation. However, Rocío alleges that the company failed to fulfill the reinstatement terms and instead pursued a lawsuit against her for moral damages after she signed a settlement agreement.

In Spain, a cook at the Son Espases university hospital in Palma has filed a lawsuit against the hospital's service concessionaire. The worker, who has over 26 years of seniority, claims her dismissal was null and void due to discrimination based on her status as a worker with a foreseeable disability. The lawsuit seeks compensation for moral damages, citing a violation of fundamental rights and European Union jurisprudence regarding equal treatment and non-discrimination.
