Labor law: Distinguishing temporary travel from permanent relocation
Legal distinctions between temporary business travel (trasferta) and permanent workplace relocation (trasferimento) are determined by the stability of the assignment rather than its duration. According to Italian jurisprudence, including rulings from the Court of Cassation, a temporary assignment is characterized by the worker's necessity to eventually return to their original headquarters, maintaining a persistent link with the initial place of work.
In contrast, a permanent transfer involves a structural change in the employee's position, where the link to the original workplace is definitively severed. This distinction is critical for determining economic rights, as travel allowances are specifically intended for provisional movements. The nature of the assignment is judged based on operational reality rather than solely on written agreements.
