Labor law expert outlines critical deadlines for just cause termination

Social Security Specialist İsa Karakaş has highlighted critical legal time limits regarding the right to terminate employment contracts for just cause. According to Karakaş, having a valid reason is insufficient if the legal deadlines are not met, as these time limits are strictly enforced by judges.

There are two primary thresholds to consider:

1. The 6-business-day rule: Once an incident is learned, the right to terminate must be exercised within six business days. The countdown begins on the first business day following the day the incident was discovered. For legal entities, this period starts when the authorized official learns of the event.

2. The 1-year rule: Regardless of when the incident is discovered, the right to terminate for just cause expires one year after the date the incident actually occurred.

Failure to adhere to either of these timeframes can result in the termination being deemed 'unjust,' potentially causing employees to lose their right to severance pay and employers to face different legal obligations.
