Labor law guidance on employee leave and statutory rights

Labor law experts and management guides highlight the importance of correctly classifying and managing employee absences to ensure legal compliance and business productivity.

Legal expert Juanma Lorente emphasizes that collective agreements cannot reduce minimum rights established by general labor statutes. Specifically, in cases involving the hospitalization or serious illness of a family member, the Workers' Statute provides for five days of paid leave. Lorente notes that even if a company's specific collective agreement stipulates only three days, the statutory five-day minimum must prevail.

Effective management of absences—including justified absences like sick leave and paid permits, as well as unpaid leave—is critical for small and medium-sized enterprises. Failure to coordinate these absences can lead to organizational disruptions, loss of productivity, and potential legal sanctions.
