Labor regulations and holiday pay updates in Costa Rica and Peru
In Costa Rica, the Ministry of Labor and Social Security (MTSS) has clarified the status of upcoming holidays for 2026. The holiday for Black Person and Afro-Costa Rican Culture on August 31 will be observed on a Monday, marking the first time it falls on a weekday since its incorporation into the Labor Code. This specific holiday is classified as a non-mandatory paid holiday. For workers with monthly, biweekly, or weekly commercial salaries, the holiday is treated as mandatory pay; however, for non-commercial weekly workers, pay depends on whether they work the day.
In Peru, discussions regarding labor compensation and wages are ongoing. The Minister of Labor noted that an increase in the minimum wage has been decided by President Keiko Fujimori and is currently being processed by the National Labor Council. Additionally, legal experts from the Chamber of Commerce of Lima have provided guidance on remuneration for the Santa Rosa de Lima holiday on August 30. They noted that if a worker performs duties on a holiday that coincides with their weekly rest day without receiving a compensatory day off, they are entitled to triple pay, which includes the holiday pay, the work performed, and a 100% surcharge.
