Labor rights and benefits for domestic workers in Spain

Domestic workers in Spain are entitled to specific labor rights and social protections, regardless of whether they work as live-in, live-out, or part-time employees. For 2026, the official minimum wage is set at 1,221 euros per month for a full-time schedule across 14 payments, which equates to 1,424.50 euros per month when prorated over twelve months. Hourly work is referenced at 9.55 euros per hour.

Standard working conditions include a maximum 40-hour work week, 30 calendar days of annual vacation, and mandatory daily and weekly rest periods. Workers are also entitled to legal leave and unemployment protection, provided they meet Social Security requirements.

Regarding maternity and childcare, domestic workers have full access to social protection benefits. Following reforms to the special regime, workers are entitled to birth or adoption leave with economic benefits paid by Social Security. These benefits cover 100% of the regulatory base from the previous month. Eligibility for these contributory subsidies depends on the worker's age and their history of contributions to the system. For those over 26 who do not meet the minimum contribution period, non-contributory maternity subsidies are available to cover the 42 days following childbirth.
