Labor rights: protections against workplace discrimination
Italian and European regulations provide legal protections against workplace discrimination and harassment. Under Italian law and EU Directives 2000/43/CE and 2000/78/CE, it is illegal to treat employees or candidates less favorably based on characteristics unrelated to professional ability, such as sex, race, religion, age, nationality, or political opinion.
Discrimination can occur at any stage of the employment relationship, including job advertisements, recruitment processes, interviews, working conditions, career advancement, and dismissal. The European Court of Justice has also ruled that public discriminatory statements can be sanctioned even without specific individual acts.
Workers and job seekers can seek judicial protection or report violations to UNAR (National Anti-Racial Discrimination Office) via a free toll-free number. In legal proceedings, once a worker provides factual elements of discrimination, the burden of proof may be reversed.
