Lahore High Court allows independent money laundering investigations

The Federal Board of Revenue (FBR) has welcomed a Lahore High Court (LHC) ruling that allows money laundering investigations to proceed independently of related tax cases. The court determined that money laundering constitutes a separate offense from the underlying tax matter, meaning authorities do not have to wait for a tax dispute to reach a conclusion before initiating proceedings under the Anti-Money Laundering Act, 2010.

The judgment, issued by a two-member LHC bench, upheld the investigative powers of the FBR’s Intelligence and Investigation wing. The court ruled that the wing has the legal authority to register cases, conduct investigations, and pursue prosecutions. Furthermore, the ruling established that an individual may face money laundering prosecution even without a prior conviction for the underlying offense that allegedly generated the funds.

This distinction clarifies that while tax proceedings focus on the assessment, collection, or recovery of taxes, money laundering investigations focus on the source and movement of potentially illicit funds. Consequently, both types of legal proceedings can move forward simultaneously.
