Land Management Department clarifies land certificate procedures

The Land Management Department has provided clarification regarding the processing of applications for land use certificates (red books) for land without existing documentation, as governed by the 2024 Land Law.

Citizens have raised concerns that when information in their declarations—such as land area or land type—differs from historical cadastral records like land registries or maps, specialized agencies are returning applications under Decree 101/2024. Petitioners argue that instead of returning files immediately, authorities should conduct field inspections to verify discrepancies, noting that land registration is a mandatory obligation under Article 131 of the 2024 Land Law.

The Department responded by noting that while registration is mandatory, Decree 101/2024 allows competent authorities to stop processing or return applications if information is inconsistent, if the submission is not within the correct jurisdiction, or if required content is missing.
