Law Society issues guidance on English and Welsh legal differences

The Law Society of England and Wales has released new guidance to assist solicitors in navigating the growing divergence between English and Welsh legislation. While both nations operate under a single legal jurisdiction, the body of devolved Welsh law has expanded significantly.

The new practice note, titled ‘Differences in English and Welsh law’, aims to help practitioners identify which legal framework applies to specific cases. Key areas of divergence identified include taxation for housing and property, social housing regulations, landlord and tenant responsibilities, and statutory frameworks for supporting children and young people with special educational needs or disabilities.

Law Society president Mark Evans noted that as Welsh law continues to develop, solicitors must remain alert to these differences to ensure clients receive accurate advice. Mark Davies, chair of the National Board for Wales, described the guidance as a welcome step in addressing the complexities of working across borders within the jurisdiction.
