Law students advocate for first-instance court decision platform
The National Council of Law Students (CNED) is advocating for the creation of a public, free platform to disclose decisions from first-instance courts. Currently, while decisions from higher courts are available online, the lack of a centralized platform for lower courts creates significant obstacles for students, researchers, and academics.
Accessing first-instance decisions often requires physical travel to competent courts, identifying applicants, and demonstrating legitimate academic interest. CNED suggests that a digital platform would bridge the gap between legal theory and practice. The proposed system would include strict anonymization rules to protect the identities of parties, witnesses, and victims, ensuring compliance with judicial secrecy laws.
The council recommends a gradual implementation involving various stakeholders, including the Ministry of Justice, the Public Prosecutor's Office, and the National Data Protection Commission.
