Lawyer charged with threatening judge in São Paulo

The São Paulo Justice system has accepted a complaint against lawyer Marcos Roberto Cebola e Silva, charging him with coercion during legal proceedings. The prosecution follows an incident during a hearing involving defendants linked to the Primeiro Comando da Capital (PCC) criminal organization.

According to the Public Ministry of São Paulo (MP-SP), the lawyer allegedly threatened Judge Deyvison Heberth dos Reis by stating he feared the magistrate might “not enter Elysium” if he did not revoke preventive detention orders. The term, referencing the Greek mythological afterlife, was interpreted by the judge and prosecutors as a veiled threat intended to constrain the magistrate’s judicial function.

In his defense, Cebola e Silva maintains that he did not issue a threat, arguing his comments regarding the afterlife were merely philosophical observations that “everyone will die one day.” The case, which originated during an investigation known as Operation Scream Fake, will now proceed to a formal criminal trial where the defense will have the opportunity to present evidence.
