Legal and financial considerations for premarital agreements

Legal and financial experts highlight the importance of discussing monetary expectations and legal protections before marriage.

In Texas, prenuptial agreements are subject to specific legal limitations. While they can address separate property and spousal support, they cannot be used to waive child support or predetermine child custody and conservatorship. Under the Texas Family Code, child support is a right belonging to the child, meaning parents cannot contractually reduce it. Additionally, courts may refuse to enforce agreements deemed unconscionable or one-sided.

In the Indian context, legal advocate Preeti Singh emphasizes the necessity of discussing debts, property, financial independence, and 'streedhan' before marriage. Singh notes that many marital disputes arise from unaddressed assumptions regarding salary, savings, and spending habits rather than a lack of affection.
