Legal and financial framework of portage salarial in France

The portage salarial system in France allows consultants to provide services to clients without establishing their own legal business structure. Under this arrangement, a third-party company employs the consultant, handles invoicing, and manages payroll.

Legal regulations, specifically within the French Labor Code, restrict this model to occasional tasks, punctual expertise, or missions outside a client's normal and permanent activity. To avoid legal reclassification by authorities such as URSSAF, consultants must maintain genuine autonomy, meaning they manage their own clients, pricing, and work organization without being subject to the client's hierarchical direction or fixed schedules. Furthermore, a mission with a single client is legally limited to a maximum duration of 36 months.

When selecting a portage company, professionals should evaluate the total cost of service. While management fees typically range between 5% and 10% of the turnover, hidden costs such as professional liability insurance, expense processing fees, or fixed monthly charges can impact the final net salary. Generally, the net salary represents approximately 45% to 55% of the turnover excluding tax, depending on social contributions and chosen benefits.
