Legal and safety concerns rise following animal collisions on roads
Recent incidents involving animals on roadways have highlighted legal responsibilities and safety risks. In Portugal, Law No. 24/2007 dictates that in the event of accidents caused by animals crossing highways, the concessionaire bears the burden of proof to demonstrate they fulfilled all safety obligations. Furthermore, competent police authorities must verify the causes of the accident at the scene, except in cases of force majeure that are not attributable to the concessionaire.
In Brazil, the death of four capybaras was reported near Pontão do Lago Sul in the Distrito Federal, suspected to be the result of vehicle collisions. This incident occurred shortly after another capybara died in the same area. Local authorities noted that under District Law No. 7.283/2023, drivers are legally required to provide assistance to animals hit by vehicles, with failure to do so resulting in fines and other penalties.
