Legal challenges arise in Paraguay and Chile over fraud and judicial errors

In Paraguay, lawyers Osvaldo Rodas Sánchez and Federico Campos López Moreira have filed a request with the Supreme Court to permanently cancel the professional license of former senator Hernán Rivas. Although Rivas was sentenced to eight years in prison for obtaining a fraudulent law degree, his license remains suspended rather than annulled. The lawyers argue that administrative responsibility is independent of criminal proceedings and that the license was ‘conceived from a false title’ and is ‘vitiated from its origin.’

In Chile, a nullity resource has been filed with the Supreme Court to overturn the conviction of Colombian physician Samir Enrique Rivaldo Hernández. Hernández was sentenced to over 21 years in prison for crimes including subsidy fraud, issuing false medical licenses, and money laundering. The defense alleges grave due process violations, claiming that the 456,000-page ruling was largely drafted using artificial intelligence and unreviewed automatic transcriptions. The defense argues these tools introduced significant errors, such as misidentifying names and contradicting evidence, which were then incorporated into the final judicial valuation.
