Legal challenges arise over bank account freezes and unattachable funds

In La Paz, attorney Joseph Abastoflor has filed a constitutional injunction against Mayor César Dockweiler and municipal tax authorities. The legal action challenges the freezing of bank accounts belonging to taxpayers with municipal debts, a measure that could affect more than 1,000 individuals. The lawsuit argues that the municipal administration's procedures violate due process and the right to defense.

Separately, the Supreme Court has ruled that portions of salaries and pensions protected by the minimum wage (SMI) remain unattachable even if they remain in a bank account beyond the month they were deposited. The court rejected the Tax Agency's argument that such funds lose their protected status and become seizable savings simply because they were not spent immediately. The ruling emphasizes that these funds are intended to meet vital needs, including non-monthly expenses.
