Legal challenges filed in Honduras and Costa Rica regarding judicial and prison decrees
In Honduras, lawyers Jenny Almendares and Delma Ordóñez, representing the Association of Relatives and Persons Deprived of Liberty (Asocideh), have filed an unconstitutionality challenge against Decree 208-2026. The decree implements prison reforms and designates three criminal structures as terrorist organizations, introducing more restrictive measures for dangerous inmates. The legal challenge argues that the decree violates fundamental rights, including human dignity and the prohibition of discrimination, specifically regarding restrictions on recreational activities. Asocideh is also considering international mechanisms to address potential cruel or degrading treatment.
In Costa Rica, attorney Randall Sequeira Hernández has formally requested that the Supreme Court's Full Court ensure a public competition is held for the election or reelection of the Attorney General. This follows news of a scheduled vote on October 19, 2026, regarding the reelection of the current official without a new background competition. Sequeira argues that current law requires a public contest to ensure objective suitability based on experience and merit, rather than relying solely on the subjective will of the electoral body.
