Legal developments in Paramacay case and John Kelvin trial

In Venezuela, lawyers from Foro Penal have been summoned to a new appeal hearing regarding the Paramacay case, scheduled for October 28 before the Court of Appeals in Carabobo. The case involves Captain Juan Carlos Caguaripano and 22 others linked to the 2017 assault on the 41st Armored Brigade. Defense representatives have criticized the procedural handling of the case, noting that the file was transferred from the first Appeals Chamber to the presidency of the Judicial Circuit after a period of inactivity, which they claim has placed the process in a ‘judicial limbo’ and threatens the impartiality of the proceedings.

In Peru, the Permanent Criminal Chamber of the Supreme Court has annulled the acquittal of singer Jonathan Sarmiento Llanto, known as John Kelvin, regarding allegations of sexual assault against his former partner, Dalia Durán. The Supreme Court granted a cassation appeal filed by the Public Ministry, citing deficiencies in how evidence was analyzed during the previous appeal process. Specifically, the court questioned the weight given to a psychological evaluation and a medical certificate, noting that the previous ruling failed to follow established rules for evidence valuation under the Criminal Procedure Code. A new sentence must now be issued.
