Legal disputes involving landowners and authorities highlight various challenges regarding property rights and agricultural management.

In Germany, legal experts note that farmers may have claims for damages under § 823 Abs. 1 BGB if excavation work for utility lines causes soil degradation, such as destroying fertile layers or backfilling with inferior materials like gravel. Such claims depend on whether previous compensation agreements specifically waived all future rights related to the construction.

Other legal conflicts involve administrative actions on private property. In one instance, a property owner faced litigation after an environmental authority ordered the removal of willow trees deemed a public safety hazard due to fungal decay. The owner was held responsible for the costs of the removal.

Additionally, disputes have arisen regarding land consolidation (Flurbereinigung). A farmer's request for building permits to renovate a residence and construct a hay warehouse was rejected by authorities who argued the projects contradicted the objectives of ongoing land consolidation and landscape protection plans.
