Francisco Garduño exonerated in 2023 Ciudad Juárez migrant station fire case

A federal judge in Ciudad Juárez has closed the criminal case against Francisco Garduño Yáñez, the former head of Mexico’s National Institute of Migration (INM). The ruling follows a legal process regarding a March 27, 2023, fire at a migration detention center that resulted in the deaths of 40 migrants and left approximately 30 others injured.

Judge Víctor Manlio Hernández Calderón determined that Garduño fulfilled the conditions for the conditional suspension of his criminal process. These conditions included providing a public apology, paying economic indemnities to the victims, and undergoing human rights and civil protection training. While Garduño stated he respected human rights and sought forgiveness, critics and legal representatives for the victims have denounced the decision as a de facto exoneration and a sign of selective justice.

President Claudia Sheinbaum stated that the closure is a judicial decision resulting from a deep investigation conducted during the previous administration. However, victims' rights groups, including the Foundation for Justice, have announced their intention to appeal the ruling, arguing that the reparations were insufficient and that the decision fails to provide full accountability for the tragedy.
