Legal reforms regarding organized crime proposed in Honduras and Costa Rica

In Honduras, analyst Juan Carlos Hernández has criticized a proposal to reform the Criminal Procedure Code that would allow tattoos to be used as evidence to link individuals to criminal groups. Hernández argued that such assessments lack sufficient scientific, qualitative, and quantitative backing, warning that relying on tattoos could lead to subjective interpretations by experts rather than objective legal proof.

Meanwhile, in Costa Rica, the Sala Tercera (Criminal Cassation Chamber) has proposed a reform to the Criminal Procedure Code regarding preventive detention. The proposal suggests that judges should consider a defendant's links to organized crime when assessing the risk of flight or the potential to obstruct justice. The reform aims to address modern criminal challenges, such as the logistical resources and territorial influence that organized structures use to evade judicial processes.
