Legal regulations for property division and co-ownership in Brazil

Legal guidelines in Brazil dictate specific procedures for the sale of property fractions and the subdivision of rural land. Under the Civil Code, a co-owner holding an ideal fraction of a property may seek to sell their portion, but must respect the right of preference held by other co-owners under equal conditions.

If an agreement cannot be reached to terminate the co-ownership, judicial sale or division may be requested. It is essential to verify the property registry and assess the possibility of physical division before negotiating.

Regarding rural properties, Law No. 5.868/1972 establishes limits on the subdivision of land. Property owners cannot divide rural areas into any size they desire, regardless of family intentions or consent. Any subdivision must respect the Minimum Parceling Fraction (FMP) applicable to the specific municipality. Even in cases of inheritance or donation among relatives, the physical division must comply with these legal limitations and the Statute of the Land.
