Legal requirements for accident insurance coverage at company Christmas parties

Legal guidelines from the German Statutory Accident Insurance (DGUV) and recent Austrian court rulings clarify when employees are covered by accident insurance during company Christmas celebrations.

For insurance to apply, four specific conditions must be met simultaneously: the company must organize or officially approve the event, a manager or authorized representative must attend, all employees must be invited, and the purpose must be to strengthen the workplace climate. Coverage is limited to the official program and the duration while a majority of participants are still present. The direct commute to and from the event is also covered, provided there are no private interruptions.

A recent ruling by the Austrian Supreme Court highlighted the risks of unofficial extensions. In a case involving a sales employee attacked after leaving a second location in the early morning hours, the court rejected the claim for accident insurance. Although the employer had attended the initial dinner and paid for drinks, the subsequent move to a different venue was not officially planned or managed by the company, meaning the event no longer qualified as a professional gathering.
