Legal requirements for valid advance directives in Germany

Legal experts highlight the necessity of precise documentation in advance directives (Patientenverfügung) to ensure medical wishes are honored. Many individuals incorrectly assume that relatives have automatic decision-making authority in emergencies. While a limited emergency representation right for spouses was introduced in early 2023, it is subject to specific conditions and time limits.

The German Federal Court of Justice (Bundesgerichtshof) has ruled that vague statements, such as “I do not wish for life-prolonging measures,” are insufficient to be legally binding. For an advance directive to be effective, it must explicitly name specific medical procedures or clearly describe particular disease and treatment situations.

A case involving a dispute among daughters regarding their mother’s artificial nutrition demonstrated that general phrasing does not clearly exclude measures like feeding tubes. To ensure legal certainty, experts recommend combining an advance directive with a care directive (Betreuungsverfügung) or a power of attorney (Vorsorgevollmacht) to designate a specific person to enforce these wishes.
