Legal rulings in Paraguay and Peru involve criminal proceedings and AI copyright
In Paraguay, the Specialized Court of Appeals for Economic Crimes, Anticorruption, and Organized Crime has confirmed that Gianina García Troche, partner of alleged drug trafficker Sebastián Marset, will undergo a joint preliminary hearing alongside co-defendants Mariano Daniel Genes Benítez and José Fernando Darío Estigarribia Cristaldo. The defense argued for a separate hearing, citing irreparable harm due to her status as a mother and her current pretrial detention. However, the court rejected this, citing principles of procedural economy and noting that the accusations stem from the same investigation.
In Peru, Indecopi’s Specialized Intellectual Property Chamber has denied a second-instance request to register three AI-generated images as works of art. The images, titled ‘Viejo Callejón de un solo caño’, ‘Café del Lunes’, and ‘Lomo Saltado en Taberna’, were rejected because the applicant failed to prove sufficient human creative intervention. The Chamber ruled that copyright protects personal and original intellectual creations resulting from human activity, and results generated exclusively by automated systems or algorithms are not eligible for protection.
