Legal rulings lift budget freeze for Guatemala's Empornac and confirm Ositran oversight of Peru's Chancay port
Guatemala's national port authority, Empresa Portuaria Nacional Santo Tomás de Castilla (Empornac), regained access to part of its 2026 budget after the Second Chamber of the Court of Appeals granted a provisional injunction. The court suspended the precautionary freeze of GTQ 196.9 million that had been imposed pending a criminal investigation, allowing Empornac to continue its operations and planned investments while the case proceeds.
In Peru, the Second Constitutional Chamber of the Superior Court of Lima upheld the regulatory authority of the Organismo Supervisor de la Inversión en Infraestructura de Transporte de Uso Público (Ositran) over the Chancay Multipurpose Port Terminal. The court overturned a previous ruling that had barred Ositran from supervising the privately‑run terminal, confirming that the regulator may exercise its duties of oversight, inspection and sanctioning in accordance with the law.
Both decisions affect key maritime infrastructure in their respective countries, ensuring continued operational capacity and regulatory oversight of major ports that are vital for international trade.
