Pity Álvarez trial continues as court rejects defense's motion to annul forensic report

The Tribunal Oral en lo Criminal y Correccional N.º 29 in Buenos Aires has rejected requests from the defense of Cristian “Pity” Álvarez to annul an interdisciplinary forensic report. The defense, led by lawyers Javier Baños and Sebastián Queijeiro, argued that the evaluation by the Cuerpo Médico Forense was “ineffective” and “invalid” because it was allegedly drafted before the necessary technical deliberations took place. They also sought the recusal of the official experts and a new examination for the musician.

Despite these challenges, the court ruled that Álvarez is capable of understanding the proceedings and ordered the homicide trial, concerning the 2018 death of Cristian Maximiliano Díaz, to continue. The next hearing is scheduled for Friday, October 16, at 11:30.

Additionally, the Solar Colonial psychiatric hospital, where Álvarez is currently interned, issued a recommendation advising against his participation in hearings, interrogations, or transfers. The medical team warned that such exposure could be “hostile to his mental health” and potentially trigger a relapse due to his underlying paranoid condition. The hospital emphasized the need to prioritize his clinical stability and requested exemption from liability should a mental health crisis occur due to judicial pressure.
