Lenia Batres remains alone in Supreme Court vote on Schenker International tax case

The Supreme Court of Justice of the Nation (SCJN) in Mexico rejected a request to intervene in a high-impact fiscal dispute involving the logistics company Schenker International. In a vote of eight against one, the Court declined to exercise its power of attraction regarding a case involving a debt exceeding 4 billion pesos owed to the Tax Administration Service (SAT).

The central legal question is whether tax authorities can revoke a company's certification, which provides foreign trade operational facilities, while a tax credit is still being contested in court. Previously, the Federal Court of Administrative Justice ruled in favor of the company, stating it was improper to cancel the registration under those circumstances. While a Collegiate Tribunal requested the Supreme Court's intervention, the Plenary ultimately voted against it.

Minister Lenia Batres was the sole vote in favor of the intervention. This follows a pattern of similar attempts by Batres to bring fiscal reviews before the Court; in November 2025, she was also the lone supporter in a vote to dismiss a similar litigation involving FEMSA and a 2.8 billion peso tax credit.
