Leszek Miller criticizes actions regarding Poland's Constitutional Tribunal
Former Polish Prime Minister Leszek Miller has criticized recent government actions involving the Constitutional Tribunal, arguing that political necessity cannot replace a legal basis. Miller contested the use of a concept he termed a “constitutional state of necessity,” noting that such a concept does not exist in serious Polish legal sources.
The crisis escalated after the government, supported by police, attempted to enter the Tribunal premises to establish order. This involved judges selected by the parliamentary majority who have not yet taken their oaths before the President. During the incident, Anna Korwin-Piotrowska, a senior judge selected by the Sejm, declared a suspension of the activities of Tribunal President Bogdan Święczkowski and Vice President Bartłomiej Sochański.
Miller stated that while the situation involves a forceful attempt to implement order, he does not characterize it as a coup d'état. However, he warned that relying on physical control of buildings and servers rather than law undermines the rule of law and sets a dangerous precedent for future administrations.
